OCR Reaches Resolution Agreement with Fairfax County Schools

On November 30, the U.S. Department of Education’s Office for Civil Rights (OCR) announced a resolution agreement requiring the Fairfax County Public Schools in Virginia to provide students with disabilities the educational services that had been neglected during the COVID-19 pandemic. During an investigation of the degree to which the district provided free appropriate public education (FAPE), OCR found that thousands of students had not received the services identified in their Individualized Education Programs (IEPs) and 504 plans during remote learning nor was the progress of those students properly tracked. The resolution agreement calls for implementation of a six point plan to ensure that the school district meets its legal obligations.
