Yesterday, the U.S. Department of Education’s Office for Civil Rights (OCR) resolved an investigation with the Los Angeles Unified School District to ensure the school district will educate students with disabilities in accordance with the Individuals with Disabilities Education Act and other federal civil rights law. OCR’s investigation into the nation’s second largest school district “found that the district failed to provide services identified in students’ Individualized Education Programs (IEPs) and Section 504 plans during remote learning.” The resolution directs the school district to provide educational services, including compensatory services, for educational losses sustained during the pandemic as well as fulfillment of services identified in students’ Individualized Education Programs and Section 504 plans. LAUSD agreed to develop and implement a comprehensive plan to address the needs of students with disabilities, and to ensure that plan is published and shared with parents.
